Terms of service.

These are the plain-English terms that apply when you engage Fresh Eyes Studio to build, host, or maintain a website. They are written to comply with the South African Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).
1. The work
We will deliver the package you select on the pricing page, in line with the brief we agree before the build starts. The scope, timeline, and price are confirmed in writing before any payment is taken.
2. Payment
On Site only and Site plus Starter, fifty percent is paid before we begin and fifty percent on launch. On Site plus Care, the build fee is paid before we begin and the monthly fee is invoiced on the first of each month. All invoices are due within seven days. SA-based clients are charged 15 percent VAT. International clients are invoiced in USD without VAT.
3. Ownership
On final payment the design files, copy, and code we have written for your site are yours. Your domain is yours throughout. We retain ownership of the underlying tooling, frameworks, and reusable components we use across multiple builds.
4. Hosting
We host every site we build on Vercel as part of the deal. We maintain the hosting, certificates, and platform updates. If you ever decide to move to another host we will export everything and help you migrate at no extra cost.
5. Edits and revisions
Two rounds of edits are included in the first week after launch. Further edits are billed per the add-on sheet, or covered by your Care plan if you have one. We respond within one business day on edits during your active build.
6. Cancellation
You can cancel a build before work begins for a full refund. Once we have started, the fifty percent deposit is non-refundable, since work has been done. On Site plus Care you can cancel any time with no notice and no penalty. Your site stays live until you ask us to take it down or to migrate it.
7. Liability
We take care to deliver work that meets the brief and the standards we publish. Our total liability for any one engagement is limited to the fees you have paid us for that engagement. We are not liable for indirect or consequential losses.
8. Governing law
These terms are governed by the law of the Republic of South Africa. Any dispute will be heard in the courts of the Western Cape, unless we agree otherwise.
